FONBET Partners Terms and Conditions

Purpose of this Agreement

The Company is a leading online gaming operator offering sports betting through its official website https://fonbet.com.cy/ in the Democratic Republic of Cyprus.

FORTUNE ENTERTAINMENT RG LIMITED is regulated and operates under the trademark FONBET, with license number B012, licensed by NBA Cyprus.

This Agreement governs the Terms and Conditions relating to the promotion of the Company’s Website, hereinafter referred to as “Fonbet”, by the Affiliate. The Affiliate will be entitled to receive a commission based on the traffic generated to Fonbet, subject to the terms and conditions outlined in this Agreement.

1.  Introduction

1.1.1 These Terms and Conditions govern the relationship between Fonbet Partners (“we,” “us,” or “our”) and the approved affiliate partner (“you,” “your”). By registering for the Fonbet Partners Program, you agree to comply with all terms herein.

1.1.2 Participation in this program constitutes a binding legal agreement. If you do not agree to these Terms and Conditions, you must cease all activity associated with Fonbet Partners.

1.1.3 Fonbet reserves the right to modify these Terms and Conditions at any time. Updates will be effective immediately upon posting on the Fonbet Partners website or notifying you via email. Continued participation in the program constitutes your acceptance of such changes.

1.1.4 This Agreement constitutes the entire understanding between you and Fonbet, superseding all prior agreements, negotiations, or communications regarding the Fonbet Partners Program.

1.1.5 The Fonbet Partners Program is subject to applicable laws and regulations in the jurisdictions where Fonbet operates. Compliance with these laws is mandatory.

2. Eligibility and Registration

2.1.1 To participate in the Fonbet Partners Program, you must be at least 18 years old or meet the legal age requirement in your jurisdiction.

2.1.2 You must provide accurate, complete, and verifiable information during registration. This includes but is not limited to personal identification, banking details, and website URLs.

2.1.3 Fonbet reserves the right to reject any application at its sole discretion, with no obligation to provide reasons for rejection.

2.1.4 Websites or channels deemed unsuitable by Fonbet will not be accepted. Unsuitable platforms include but are not limited to those that:

2.1.4.1 Promote illegal activities or violate intellectual property rights.

2.1.4.2 Contain content aimed at children or other vulnerable groups.

2.1.4.3 Display explicit, violent, discriminatory, or otherwise offensive material.

2.1.5 You are responsible for ensuring that your activities comply with all applicable laws and regulations in your jurisdiction.

2.1.6 The Affiliate hereby warrants and undertakes the following obligations upon registration:

2.1.6.1 To make its best efforts to actively and effectively advertise, market, and promote Fonbet as widely as possible to maximize the benefit to both Parties. The Affiliate agrees to adhere to the guidelines provided by the Company from time to time, whether communicated directly or accessible online.

2.1.6.2 To independently market and refer potential players to Fonbet at their own cost and expense. The Affiliate will be solely responsible for the distribution, content, and manner of its marketing activities. All marketing efforts must be conducted professionally, lawfully, and in compliance with applicable laws and the terms of this Agreement.

2.1.6.3 To use only the links or material provided within the scope of the Partner Program. No warranty or responsibility is assumed by the Company for proper registration or revenue accounting in the absence of such links or material. The Affiliate further warrants not to modify or alter any provided link or marketing material without prior written authorization from the Company.

2.1.6.4 To ensure that all marketing efforts are directed towards individuals who are over 18 years of age and who fulfill the Company’s user acceptance rules.

2.1.6.5 To be solely responsible for the development, operation, and maintenance of its website, including all materials appearing on the website.

2.1.6.6 To maintain confidentiality regarding any “sensitive” information shared by the Company, including details about the Company’s services or technical aspects of the Affiliate Program. Such information is to be used exclusively for the benefit of both Parties and must not be disclosed without prior approval from the Company. This obligation remains in effect even after the termination of the Agreement.

2.1.6.7 To fully comply with the General Data Protection Regulation (“GDPR”), the regulations of Personalization and Electronic Communications (EU guide) of 2003, and any other applicable laws governing data protection.

2.1.7 The Affiliate further warrants:

2.1.7.1 That it will not engage in any act that is libellous, discriminatory, obscene, unlawful, or otherwise unsuitable, nor will it promote materials containing sexually explicit, pornographic, obscene, or graphically violent content.

2.1.7.2 That it will not target individuals who are under the legal age for gambling.

2.1.7.3 That it will not target any jurisdiction where gambling and the promotion thereof is prohibited by law.

2.1.7.4 That it will not engage in illegal or fraudulent activities, including, but not limited to, the following:

2.1.7.4.1 Sending spam.

2.1.7.4.2 Using incorrect metatags.

2.1.7.4.3 Registering as a player or making deposits directly or indirectly to any player account through its tracking links for personal use, or the use of relatives, friends, employees, or other third parties, with the intent to artificially increase commission payments or defraud the Company.

2.1.7.4.4 Any violation of this provision shall be considered fraud.

2.1.7.5 That it will not present its website in a manner that could cause confusion with Fonbet or the Company, nor give the impression that the Affiliate’s website is directly or partially associated with or originated from Fonbet or the Company.

2.1.7.6 Without prejudice to any marketing materials provided by the Company, the Affiliate agrees not to use the trademarks or any other intellectual property rights of Fonbet or the Company unless prior written consent has been obtained from the Company.

2.1.7.7 That it will not act as a player on Fonbet, nor generate turnover for which it claims commission through personal or related accounts.

3. Referral Commission Structure

3.1.1 As a Fonbet partner, you will earn Referral Commissions based on the net revenue generated by customers referred through your unique tracking links.

3.1.2 An active referred customer is defined as a visitor who:

3.1.2.1 Clicks on your unique tracking link and registers on the Fonbet platform.

3.1.2.2 Deposits funds into their account.

3.1.2.3 Engages in bettine activities.

3.1.3 The commission is calculated as a percentage of net revenue, which is revenue generated from referred customers after deducting winnings, bonuses, chargebacks, and other promotional costs.

3.1.4 Commission and plan tiers are detailed on the Fonbet Partners website and are subject to periodic review.

3.1.5 Fonbet reserves the right to adjust your commission rate if your promotional efforts decline or fail to meet agreed-upon standards.

4. Payment Terms and Methods

4.1.1 Referral Commissions are calculated and paid monthly, provided the minimum payout threshold has been met.

4.2 Fonbet reserves the right to withhold payments if fraudulent activity, non-compliance, or breaches of this agreement are suspected.

4.3  Minimum payment:  50 euro via BANK TRANSFER

4.4  Any commission generated from users who have self-excluded will be reversed and de-tracked from the respective partner’s account. No commission will be paid to the partner for any activities associated with those users.

4.5 The Company reserves the right to establish minimum activity thresholds for affiliate accounts. These thresholds will be periodically reviewed, and the Company may terminate any agreement that does not meet the required activity level. Such thresholds will be set reasonably and are intended to ensure that affiliate accounts generate sufficient revenue to cover the Company’s internal costs related to account maintenance and payout processing.

5. Marketing and Promotion

5.1.1 You are granted a non-exclusive license to use Fonbet marketing materials during the term of this Agreement.

5.1.2 Fonbet marketing assets must be displayed prominently on your website or channel, and you must not alter these materials without prior consent.

5.1.3 Any advertising must comply with applicable regulations, including but not limited to advertising codes of conduct and laws related to gambling.

5.1.4 You must not engage in misleading, deceptive, or unethical promotional practices.

5.2. Compliance with Marketing Laws

  • Prohibited Practices:

5.2.1.1 Affiliates must not use false advertising, deceptive claims, or unapproved promotional methods to attract Players.

5.2.2 Social Media and PPC Campaigns:

5.2.2.1Affiliates must comply with Fonbet’s specific policies for social media promotions, pay-per-click (PPC) campaigns, and other online advertising formats.

6. Duplicate Accounts and Self-Referrals

6.1.1 You are prohibited from opening multiple Fonbet partner accounts without prior written consent.

6.1.2 You are not permitted to earn commissions on your own or betting activity.

6.1.3 The Fonbet Partners Program is intended for professional publishers only. Abuse of the system will result in termination and forfeiture of commissions.

7. Termination and Post-Termination Obligations

7.1.1 This Agreement remains in effect until terminated by either party.

7.1.2 Termination may be initiated at will, with or without cause, by providing written notice (email is acceptable).

7.1.3 Upon termination, you must immediately:

7.1.3.1 Remove all Fonbet banners, links, and promotional materials from your platforms.

7.1.3.2 Cease using Fonbet intellectual property.

7.1.4 Fonbet reserves the right, at its sole discretion, to terminate this Agreement if your site or platform is deemed unsuitable. Unsuitable sites include, but are not limited to, those that:

7.1.4.1 Target or are designed to appeal to children or vulnerable populations.

7.1.4.2 Contain or promote pornographic material or other illegal sexual content.

7.1.4.3 Advocate, glorify, or incite violence, hate, or harm.

7.1.4.4 Promote discrimination on the basis of race, sex, religion, nationality, disability, sexual orientation, or age.

7.1.4.5 Engage in or facilitate illegal activities or the promotion thereof.

7.1.4.6 Infringe on intellectual property rights, including copyrights, trademarks, or patents.

7.1.4.7 Breach any relevant laws, advertising regulations, or established codes of practice applicable in your or Fonbet’s jurisdiction.

7.1.5 The determination of unsuitability is final and will result in immediate termination of this Agreement, without notice, and may include withholding any outstanding commissions if linked to non-compliant activity.

8. Limitation of Liability

8.1.1 Fonbet will not be liable for indirect, special, or consequential damages, including but not limited to loss of revenue or profits.

8.1.2 Total liability under this Agreement is limited to the Referral Commissions paid to you.

9. Indemnity

9.1.1 You agree to indemnify and hold Fonbet, its employees, and directors harmless against any claims, damages, or liabilities arising from:

9.1.1.1 Your breach of this Agreement.

9.1.1.2 Non-compliance with applicable laws.

9.1.1.3 Misuse of Fonbet’s materials.

10. Disclaimers

10.1.1 Fonbet makes no guarantees regarding uninterrupted service or error-free operation of tracking systems and will not be held liable for any losses, damages, or consequences resulting from any interruptions, errors, or failures related to the operation of our services or systems.

10.1.2 In the event of discrepancies, Fonbet’s internal database records will be deemed accurate.
10.1.3 Partners acknowledge that participation in the Partner Programme is undertaken at their own risk, and Fonbet shall not be responsible for any consequences resulting from any failure of Partners to understand applicable laws and regulations, failure of technical or other issues related to Partner’s Operations.

11. Confidentiality and Data Protection

11.1.1 All information shared during the term of this Agreement is considered confidential.

11.1.2 Fonbet processes partner data in accordance with applicable data protection regulations.

12. Governing Law

12.1.1 This Agreement is governed by the laws and directives of the Democratic Republic of Cyprus.

12.1.2 Any disputes will be resolved via arbitration or mediation.
